Trade Mark Services

Better use of technology, including the much improved online capabilities of the official websites has allowed us to significantly reduce both the cost and the level of internal infrastructure required, allowing us to dramatically change the pricing model without sacrificing any quality of service.
Our Pricing Model
Our pricing model is simple and certain and delivers value:·
$A 599 per application filed (any number of classes)·
$A 749 prosecution fee per trade mark·
AU$1,499 for oppositions and non-use proceedings·
AU$2,499 for attending a hearing in relation to examination of an application·
$NIL Trade Mark renewal for up to 20 marks
(agreed fixed fee for additional marks)·
$as agreed Trade Mark Searches.·
$395 per hour for other services and advice
1. charges are excluding official fees and agents fees, which are passed on at cost.
2. GST (Goods and Services Tax) is additional where applicable.
Some more detail:
Trade Mark Application Filing Fee
This charge includes filing an application, reporting acceptance, attending to payment of registration fees and forwarding a certificate of registration. In the absence of objections during examination or opposition this will be our only charge.
For Australia these are AU$200 per class payable on filing and AU$300 per class payable on expiration of the opposition period and prior to the issuance of a Certificate of Registration.
For New Zealand, the official fee is NZ$100 per class payable on filing.
For any other countries we will provide an estimate of official fees and agent's fees.
Prosecution of Trade Mark Application
Prosecution is only required where an examiner raises objections to registration of a trade mark. Included in this service is:
Reporting on the examination, with recommendations;·
Preparing and lodging:
the initial response to the Examiner’s report;
any required further submissions; and
evidence of reputation where necessary
any co-existence negotiations with any owner of a prior mark including preparing consen documents as required
We will provide up-front estimates of agent's fees where necessary.
Opposition and Non-Use Proceedings
This service covers representation of an Applicant or Opponent in Trade Mark Opposition or Non-Use Proceedings including:
preparing and filing, or receiving and reporting, Notices of Opposition or Non-Use Proceedings; and
preparing and lodging evidence and negotiating settlement, until the proceeding is settled or set down for a hearing.
Additional charges based on hourly rates may be applicable for complex advice or preparation of complex settlement documents.
Representation at a Hearing
This service covers preparation and representation at a Trade Mark Opposition, Trade Mark Non-Use Proceeding or Trade Mark Prosecution Hearing.
Australian Renewal Fees are currently A$300 per Class and New Zealand Renewal Fees are NZ$172.50 per Class. Advance payment of Renewal Fees will be required.Where you wish us to renew more than 20 different trade marks on your behalf, we will agree a low fixed per mark rate to cover our costs, irrespective of the number of classes.
Trade Mark Searches
A searching strategy and estimate of costs will be provided on receiving instructions. Business, company name and domain name searches can also be conducted.
Note that both the Australian and New Zealand Trade Mark Offices will provide the results of Official Pre-Filing Searches for Official Fees of less than A$100. In both countries applications can also be examined shortly after filing. These procedures may avoid the need to incur the costs of detailed pre-filing trade mark searches.
